Welcome to Echo Club, operated by Unblocked Brands, Inc. ("Unblocked," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of the Echo Club platform and related services (the "Platform"). By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
Echo Club connects creators with brand partners through campaign-based opportunities called "Missions." Creators can participate in Missions by creating content, engaging with brands, sharing content, and completing other activities across various third-party platforms. Creators may earn compensation and/or "Gems" (points redeemable for rewards within the Platform) based on their participation. We do not guarantee that any particular Mission, reward, or feature will be available to you at any time, and the availability, requirements, and reward amounts of Missions may change at any time without notice.
To participate in Missions and receive compensation, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.
You are an independent contractor, not an employee, agent, or partner of Unblocked or any brand partner. Nothing in these Terms creates an employment, joint venture, partnership, or agency relationship. You are solely responsible for your own equipment, internet access, taxes, insurance, and any other costs associated with your participation. You are not entitled to any employee benefits, including health insurance, retirement plans, paid time off, or workers' compensation. You acknowledge that Unblocked does not withhold taxes from your earnings and that you are responsible for all tax obligations arising from your participation.
You retain ownership of content you submit ("Creator Content"). By submitting Creator Content, you grant Unblocked and applicable brand partners a perpetual, worldwide, royalty-free, sublicensable license to use, modify, reproduce, distribute, and display your Creator Content for any purpose, including advertising and marketing. Brand partners may use your Creator Content for their own commercial purposes. Unblocked may use your Creator Content, name, and likeness to promote the Platform.
Avatar, likeness, and voice. Certain features and Missions allow or require you to upload photos or other images of yourself and to record samples of your voice. By uploading them, you expressly authorize Unblocked to use those images and voice recordings to create, reproduce, store, and use a digital avatar or replica of your likeness and a simulation of your voice, and you grant Unblocked and applicable brand partners the right to use your name, image, likeness, voice, and persona in content created with that avatar, consistent with the license above. You will be asked to confirm this permission in writing when you upload. Your uploads and the data derived from them are retained and destroyed according to the schedule in our Privacy Policy. You may request deletion of your avatar and the images and recordings used to create it at any time; content already created with your avatar may remain subject to the license above.
You represent that you own or have rights to all Creator Content you submit, that any social media accounts you connect or submit content from are your own, and that your Creator Content does not infringe any third-party rights or violate any laws.
You are solely responsible for complying with FTC guidelines regarding sponsored content disclosure. You must clearly disclose the sponsored nature of any content you create for Missions using appropriate disclosures (for example, #ad or #sponsored). Unblocked is not responsible for penalties resulting from your failure to disclose.
You are solely responsible for complying with the terms of service and community guidelines of any third-party platform on which you participate in Missions. Unblocked is not responsible for and disclaims all liability arising from any actions taken against you by third-party platforms, including account suspension, content removal, or termination, regardless of whether such actions relate to your participation in Missions.
9.1 Earning methods. Compensation for Missions varies and may include flat fees, performance-based bonuses, or other structures as disclosed in each Mission brief. Not all activities result in monetary compensation; some may award Gems or other non-monetary rewards.
9.2 Wallet and payouts. Earnings are deposited into your in-app wallet following campaign completion and review. You may request withdrawal of available funds, subject to a minimum payout threshold of $100 and to verification and compliance review before payment. Before processing a payment, we may require you to verify your identity and provide tax or other compliance information, and we may delay or withhold payment until that information is provided and approved. Payments are delivered through third-party payment providers using the payout methods offered in the app. Withdrawal fees and processing costs, and any fees imposed by third-party payment providers or your financial institution, are your responsibility.
9.3 Tax compliance. You are responsible for all taxes on your earnings. Unblocked or its third-party payment and tax-reporting providers will issue required tax forms to creators who meet applicable federal thresholds. Tax-related questions and documents may be sent to hello@echoclub.fun.
9.4 Errors and fraud. We may adjust, reverse, or revoke earnings or rewards that were credited in error or that we reasonably believe were obtained through fraud, abuse, or violation of these Terms.
Gems are points earned through Platform activities and are redeemable only for rewards offered within the Platform. Gems have no cash value, are non-transferable, and cannot be exchanged for currency. Unblocked reserves the right to modify the Gems program, reward availability, and redemption rates at any time.
11.1 General. Unblocked may offer sweepstakes (random drawings) and contests (skill-based competitions) through the Platform. Each promotion will have its own Official Rules specifying eligibility, entry methods, prize details, and other terms. In the event of conflict between these Terms and specific Official Rules, the Official Rules govern.
11.2 Eligibility. Promotions are open to legal U.S. residents 18 years or older unless otherwise specified. Void where prohibited by law. Employees of Unblocked, its affiliates, and their immediate family members are not eligible.
11.3 Entry.No purchase or payment is necessary to enter any sweepstakes. Entry methods may include completing Missions, posting content, referring friends, or other activities as specified in the Official Rules. For any promotion requiring consideration to enter, a free alternative method of entry ("AMOE") will be available by emailing hello@echoclub.fun with the promotion name in the subject line.
11.4 Prizes.Prizes may include cash, physical products, digital products, Gems, experiences, gift cards, or brand products. All prizes are awarded "as is" without warranty. Prize values are determined at time of award. Winners are solely responsible for all taxes, fees, and costs associated with prize acceptance and use.
11.5 Winner selection and notification. Sweepstakes winners are selected by random drawing. Contest winners are selected based on judging criteria specified in the Official Rules. Winners will be notified via email or Platform notification and may be required to complete an affidavit of eligibility and liability/publicity release. Failure to respond within the specified timeframe may result in forfeiture and selection of an alternate winner.
11.6 Publicity. By accepting a prize, winners grant Unblocked the right to use their name, likeness, and entry for promotional purposes without additional compensation, except where prohibited by law.
11.7 Limitations. Unblocked reserves the right to cancel, modify, or suspend any promotion if fraud, technical issues, or other factors impair its integrity. By entering, participants release Unblocked and its brand partners from any liability arising from participation or prize acceptance.
We track content performance using third-party tools and public data from connected social media accounts. Our tracked metrics are final for compensation purposes. We may adjust or reject metrics we reasonably believe are artificially inflated through fraudulent methods.
The Platform may offer referral rewards. Referral rewards are subject to the rules presented in the app, are available only for genuine referrals of new, eligible users, and may be withheld or reversed in cases of suspected fraud or abuse, including self-referral and incentivized or automated signups.
You agree not to:
We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent activity. If terminated for cause, you forfeit all wallet balance, Gems, and pending earnings. We may claw back amounts obtained through fraud. If you voluntarily close your account in good standing, wallet balances above the minimum threshold will be paid out; balances below the threshold and Gems are forfeited.
If your account remains inactive for an extended period, any funds in your wallet will be handled in accordance with applicable state unclaimed property and escheatment laws. We may attempt to contact you before any such action is taken.
By creating an account, you consent to receive electronic communications from us, including emails, push notifications, and Platform notifications, regarding your account, Missions, earnings, Platform updates, and promotional offers. You agree that electronic communications satisfy any legal requirement that communications be in writing.
You may opt out of promotional communications at any time by following the unsubscribe link in any marketing email or by adjusting your notification settings. You may not opt out of transactional communications related to your account, earnings, or legal notices.
Unblocked reserves the right to modify, suspend, or discontinue all or any portion of the Platform at any time, temporarily or permanently, without notice. We will have no liability for any change to the Platform or any suspension or termination of your access to the Platform.
The Platform and all content (excluding Creator Content) are owned by Unblocked and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our consent.
Our Privacy Policy governs the collection and use of your personal information and is incorporated into these Terms by reference.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE ANY MINIMUM EARNINGS, VIEWS, OR PERFORMANCE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNBLOCKED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID TO YOU IN THE SIX MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless Unblocked and its brand partners from any claims arising from your Creator Content, Platform use, violation of these Terms, violation of third-party platform terms of service, or failure to comply with FTC requirements.
24.1 Binding arbitration. You and Unblocked agree that any dispute arising from these Terms or the Platform shall be resolved by binding arbitration, except that either party may bring claims in small claims court if eligible. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules.
24.2 Class action waiver. You and Unblocked agree to bring claims only in individual capacity, not as a plaintiff or class member in any class or representative proceeding.
24.3 Opt-out. You may opt out of arbitration by sending written notice to Unblocked Brands, Inc., Attn: Legal - Arbitration Opt-Out, 9000 Washington Blvd, Culver City, CA 90232, within 30 days of accepting these Terms.
24.4 Exceptions. Claims alleging sexual assault or harassment may be brought in court per the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act.
These Terms are governed by California law. For disputes not subject to arbitration, you consent to exclusive jurisdiction in Los Angeles County, California courts.
We may modify these Terms at any time. Material changes will be communicated via email or Platform notification. Continued use after changes constitutes acceptance.
These Terms constitute the entire agreement between you and Unblocked. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign without restriction.
